Credit Repair and the Better Business Bureau

Many chapters of the Better Business Bureau have automatically given credit repair organizations “F” ratings simply because they are, well, credit repair organizations. These chapters say as much in their explanation for their reviews. Specifically, the aforesaid Better Business Bureau chapters state: “BBB concerns with the industry in which this business operates.”

It is inherently unfair to give a business an “F” rating and thereby, damage a businesses reputation simply because the Better Business Bureau is “concerned” with the industry in which a business operates. Credit repair organizations provide a valuable service to consumers who would otherwise not be offered credit or high interest rates due to inaccurate items on their credit reports which falsely lower their scores. Not all credit repair organizations are “scams” which is precisely what the Better Business Bureau is implying by their statement.

One BBB chapter, however, ironically gives the credit repair organization Lexington Law an A- rating. This is despite the fact that they have 272 consumer complaints within the last 36 months.

This is hard to reconcile to say the least. In short, please note that not every word from the Better Business Bureau should be taken as the gospel and members pay for inclusion.

Closed accounts do account for some percentage however, only accounts which are currently open can accrue points now. Closed accounts do nothing in terms of increasing scores. Open accounts are also used to calculate payment histories.

2) We achieve amplifying the above elements upon your credit reports by adding you to seasoned tradelines which are simply revolving accounts; i.e., credit card accounts. These accounts are held by persons whom our owner graduated law school with, college with, staff, our friends, and family members. All of Apex Credit Services seasoned tradeline additions exhibit perfect payment histories. They are maintained for the explicit purpose of our clientele.

Once more, all in all the process is extremely simplistic. We contact the creditors and request your addition to the accounts in question. Generally, within 30 to 45 days, the creditors report those accounts to your credit reports although it can take up to 90 days pursuant to our Agreements. While the extreme exception rather than the general rule, if they do not report within 90 days you shall be entitled to a refund.

3) The seasoned tradelines appear on your reports. The date opened is the date the account was opened, not the date you were added. The credit limit is reported. The payment history is reported. It is scored as if it were your own account. By virtue of this, your scores can increase significantly and rapidly (usually within 30 days).

Of course, you cannot use the account nor do you receive a card. In essence, you are paying for the score increase which is the goal behind the process ultimately. Fair Isaac (FICO)

Fair Isaac (hereinafter, “FICO”) is the company which designs and implements the most universally accepted scoring model used today. It is commonly known as the FICO score. Today, the three major credit reporting agencies, Equifax, Experian, and Trans Union, permit FICO to apply models to their data which all consider “authorized user” accounts. These models are many but, are referred to as a Beacon, Emperica, or a Classic score depending upon the credit reporting agency to which it is applied.

With that said and no matter the name given, these models are in compliance with the Equal Credit Opportunity Act (hereinafter, the “ECOA”), enumerated in the United States Code at 15 U.S.C. 1691 et seq. The legislative intent and stated purpose of the ECOA was and remains in force to protect consumers from discriminatory and unethical practices in lending.

Nevertheless, FICO proposed in June of 2007 a new scoring model which would completely disregard authorized user accounts. One credit reporting agency was allegedly set to begin using this model in September of 2007. Which one is still unknown however, it never happened. No credit reporting agency has issued a statement to this effect and Equifax has recently stated that they will not allow FICO to apply this model to their data. The other two credit reporting agencies are set to review the model at some point in 2008 however, each and every request as to whether any credit reporting agency is going to permit this model to be applied to their data is garnering a more tenuous and ambiguous response notwithstanding Equifax which has explicitly conveyed a resounding no.

Let us be clear, this proposed model is illegal pursuant to the ECOA. One can review the following pertinent provision of the aforementioned Act and find this to be true:

(6) Credit history. To the extent that a creditor considers credit history in evaluating the creditworthiness of similarly qualified applicants for a similar type and amount of credit, in evaluating an applicant's creditworthiness a creditor shall consider:
(i) The credit history, when available, of accounts designated as accounts that the applicant and the applicant's spouse are permitted to use . . .

As anyone can discern, the law clearly states that "any" account which an applicant is permitted to use must be considered. This certainly envelopes authorized user accounts. With that in mind, it is only reasonable to forecast a windfall of class litigation that very well may affect Fair Isaac’s, the credit reporting agencies, and anyone who uses that method bottom lines. This is why only one credit reporting agency was set to implement the changed model in September. Again, it didn't happen and now, Equifax is even unwilling to sit back and wait for the fallout.

This new model was projected to adversely affect 41 million Americans with respect to their credit scores. The reasons given for the so-called need for this change are many but, they are in essence a call for relief from the mortgage industry. After the sub-prime mortgage industry fell through the bottom, the aforesaid industry needed an explanation for their shareholders. Rather than admit to the truth which was that they were approving applicants with 520 mid-scores at 100% financing and nearly at 60% DTI, they blamed a small niche of consumers who knew how to operate shrewdly under FICO models to increase their scores legally.

Presuming that any credit reporting agency proceeds as once planned and fails to see any temporary restraining orders or declaratory actions, the new model would have virtually no effect on consumers. This is because most mortgage and automobile lenders, even some credit card issuers, rely on the middle of the three scores. Consumers will continue to reap the benefit of authorized user accounts on two reporting agencies even if one credit reporting agency would give it a trial run. Again, only Experian and Trans Union have said that they are even willing to review the new FICO 08’ at some point in 2008. They have not said they will use it and we are cautiously optimistic that they will follow the ECOA and decline to do so.

With all this said and assuming arguendo that they would enact the change; it wouldn't affect most consumers until and "if" they apply the change in a retroactive nature. This has not been made clear. Moreover, the bigger question is what creditor would adopt using FICO 08' given the enormous potential for civil liability in a class context. The obvious answer is not many. It just doesn't make sense from a legal or business perspective. This is why FICO 08' has yet to happen.

Apex Credit Services, LLC, did a wonderful job in repairing my credit as well as my wife’s. They know what they are talking about and know the FICO models inside and out. Had good experiences with Apex Credit Services, LLC. Bought the seasoned tradeline services they offer along with their credit restoration product and got about a 170 point jump. I’d highly recommend Apex Credit Services.

Apex Credit Services, LLC did a fanatastic job with my credit repair. I bought Apex Credit Services “credit restoration” service and purchased two, ten year old seasoned tradelines. Took about 60 days but, when Apex Credit Services was done my score had risen about 140 points to a 731. They did everything they said they would, answered all my questions and provided me screenshots/copies of everything.

A very professional credit repair firm to say the least. I suppose that’s why their bonded with Hartford, a three year member of the Better Business Bureau, certified by the CDIA, licensed and registered with the WV Secretary of State, and ran by attorney’s and paralegals. These guys know their stuff!

This corporation is a great credit repair firm. Apex Credit Services lead me by the hand throughout their 90 day plan (I was a bit naive about it) and explained everything to a fault. Their projections were pretty dead on and I couldn’t be happier. I say thumbs up for Apex Credit Services.

Apex Credit Services, LLC did exactly as they promised in adding my seasoned tradelines and credit repair. Apex Credit Services took my score from about a 520 to 690 in slightly less than 90 days. While Apex Credit Services, LLC charged me 1,800.00, it was money well spent and I found them to be more professional than any other credit service organization I talked to.

Apex Credit Services, LLC took me from a 560 to 743 in slightly less than 90 days. During this time, they were responsive to all my needs and questions.

Apex Credit Services performed to rounds of escalated credit repair and added three tradelines to my reports. It went off flawlessly.

I would strongly recommend Apex Credit Services, LLC for both credit repair and seasoned tradeline services. Their prices are actually cheaper than most and the customer service is excellent. Moreover, they seem to be attorneys and paralegals whereas most of the other companies seem to be something less than.

My scores in late ‘07 were 500ish Fako and non-existant FICO. I was about to go through both payment in fulls and Lexington Law before I came across Apex. Rather then the usual ‘fill this out and pay per month’ I ended up talking to a real person, who listened to my situation and put together a real game plan based on my situation and goals.

Wiht their guidance and assistance, I have managed to get my scores to the 700+ range. They never engage in questionable practices (e.g. disputing inquiries with ‘Fraud’ claims that haunt you for your years) and balance aggressive tactics will long term gain.

Highest marks in a field full of charlatans…

Apex Credit Services, LLC was easily the most educated and professional credit repair firm I spoke with. They were founded by a consumer attorney and it appears that their staff is mainly paralegals. I found them to be completely honest and that they actually were attempting to prohibit me from going overboard. Apex Credit Services actually could have sold me more services but, they stuck by their projections which were far cheaper. Turns out they were right. In any event, I liked the fact that they discussed all my options with me for about three days before I even finally retained them.

Within roughly ninety days, my scores had went from a 587 to a 718 (mid-score). They communicated with me and put all my fears to rest. Again, very professional and informative. It felt like I was with a law firm rather than a credit repair agency.

Apex Credit Services is the best in the credit repair business.

Apex Credit Services is a top-flight credit repair agency. They corresponded with me promptly and increased my scores about 130 points in 90 days. I don’t know of anyone that does what Apex Credit Services does in this field, but I’d recommend them to anyone.

This is a long story but, a good one. I didn’t initially have a contract with Apex Credit Service, LLC however, they definately helped me. A guy that I won’t mention sold me a fake CPN number and told me that a few tradelines would be added to it. Well, they never were and he said it was Apex Credit Services, LLC’s fault. I called them and explained who I was. Jason Barnette personally looked into it and told me that they didn’t work with CPN’s and that they were illegal. The same guy that sold me this garbage refused to talk to me or refund my money however, Mr. Barnette and Apex Credit Services put the lines on my real social security number credit report. My scores increased a great deal.

They didn’t have to do this. They did it because Mr. Barnette is an attorney and Apex Credit Services actually believes in doing things the right way. All I can say is that this man is honest, professional and Apex Credit Services does what they say they will. They are sort of a watchdog in a terrible industry full of scammers.

Apex Credit Services, LLC was great to work with and came through with what they projected. Apex Credit Services didn’t nit-pick one or two tradelines instead, they disputed everything by specific inaccurate or incomplete data field. As a result, I saw a good many items deleted.

Apex Credit Services also added some positive tradelines which posted within 60 days. My FICO score jumped about 120 points within the 90 days I was with them.

They are well-trained and answered all the questions I had. No issues with them whatsoever and I would highly recommend them.
